GENERAL TERMS OF USE AND SALE

This User Agreement describes the terms and conditions applicable to your use of our services available under the domain and sub-domains at www.digitalisme.com. The general terms of use and sale of DIGITALISME.COM are hereafter named as « General Terms ».
The General Terms describe the conditions according to which DIGITALISME.COM [de la Houlette avenue 78 bte 48 B-1160 AUDERGHEM - BELGIUM. T : +32 2 726 93 76] (named as "DIGITALISME.COM" or "we") grants you access to its services on the following websites :

www.topnicegirls.com and its sub-domain
(hereafter the “Websites”).

If you do not agree to be bound by this User Agreement, you may not use or access our services.

Article 1 - Conditions of inscription

Our services are not available to, and may not be used by, persons under the age of 18 years or to temporarily or indefinitely suspended members or person not having the legal capacity. If you are under 18 years old, you can use this service but we recommend to use it with and under the supervision of a parent or guardian. If you do not qualify, please do not use our services. If you are registering as a business entity, you represent that you have the authority to bind that entity to the General Terms.

Article 2 - Services

By subscribing to the services, DIGITALISME.COM grants you a temporary user license having different duration following your type of subscriptions. The prices are described in the contracting process.
The pictures you will find on the Websites are artistic and have, by no means, any pornographic or sexual content. All models are professionals coming from models’ agency.

Article 3 - License of use

The licence entitles you to access the Website. This licence grants you a private, not collective and not exclusive, right to access the content of the Websites. Any networking or any re-diffusion, in any form whatsoever, is prohibited.

The reproduction right is limited only to the representation on a single-user screen
and is strictly reserved for your private use. If you wish to use the content of the site commercially, our express agreement shall be required. In that case, you may send us an email at the following address: sales@digitalisme.com
Any representation or reproduction, integral or partial, which could be made of it without the consent of their authors or their successor or right holder, is illicit. You may in consequence not modify, copy, transmit, assign and, generally, exploit these materials.

Article 4 - Renunciation

In accordance with article 80, §4 of the law relating to the good trade practices, as far as the execution of the contract has started, with the consumer agreement, before the end of the seven working days delay, you have no renunciation right to the contract concluded with DIGITALISME.COM.

Article 5 - Right of modification

DIGITALISME.COM reserves the right to change, modify, add or remove portions of the General Terms in its sole discretion at any time and without prior notice. By accessing or using this Site after any change in the General Terms is posted, you agree to be bound by the changes as well. Nevertheless, the modifications come into effect 15 days after they are on line on the Website, or at any other time specified in the notification, or by sending email to the members having required it. No exemption of these General terms will be authorized, except by writing and signing a new contract with DIGITALISME.COM. We also reserve the faculty to modify the characteristics or the contents of the Websites. We can also restrict the access of the Site to certain pages and this, without preliminary notice.
DIGITALISME.COM may, in its sole discretion, suspend, interrupt or prohibit the access to whole or part of the Site for any reasons, including in particular the infringement of the General Terms. We do not guarantee that the website does not contain any errors neither that all the imperfections will be corrected.
DIGITALISME.COM reserves the right to send you, individually or to all the users of the Websites, an e-mail in order to hold you informed about changes, modifications or additions that occurred on the Site.

Article 6 - Transfer - Confidentiality

The user will be issued with a unique user name and a unique password, which the user shall only use or allow to be used for the permitted use at the Websites. Your account DIGITALISME.COM may not be transferred to thirds. You shall be responsible for all the operations carried out with your user name and your password and you shall use one of the sites of DIGITALISME.COM only with your own user name and password. You shall take all necessary measures to protect your password and to keep it confidential to third parties. Neither shall you authorize somebody else to use, directly or indirectly, your user name and password.

Article 7 - Links to pages of thirds

DIGITALISME.COM provides links to third party webpage through www.gigatoplinks.com site. These Websites are neither being held, nor exploited, nor controlled by DIGITALISME.COM and we are not responsible about their contents. You shall use these links at your own risks. You are not authorized to establish a link neither between the Websites and your own website nor between the Websites and any other website without the prior written consent of DIGITALISME.COM.

Article 8 - Divisibility of the conditions

If a part of a disposition or any disposition of the present general terms should be declared inapplicable or incompatible to the applicable law of any jurisdiction, this inapplicability or incompatibility will not affect the validity of the valid part of disposition or the valid disposition.

Article 9 - Applicable law

These Terms and Conditions are governed and construed in accordance with the laws of Belgium.

Article 10 - Jurisdiction

The sole jurisdiction and venue for any action that may arise under or in relation to the subject matter hereof shall be the courts of Belgium.
